These Terms of Service ("Terms") describe your rights and responsibilities when you use our website, store, and services. The terms "we," "us," and "our" refer to Bevel Brands LLC, a Wyoming limited liability company that operates the Belvarnè brand. Belvarnè is a trade name of Bevel Brands LLC. We operate this online store and website, including all related content, features, tools, products, and services (together, the "Services"). Our store is powered by Shopify.

Please read these Terms carefully. They include important information about your legal rights, including warranty disclaimers, limitations of liability, an arbitration agreement, and a class action waiver.

By visiting, browsing, or purchasing from Belvarnè, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Services.

1. Eligibility and Accounts

You must be at least 18 years old to use the Services or make a purchase. By agreeing to these Terms, you represent that you are 18 or older and have the legal capacity to enter into this agreement.

To use certain features of the Services, you may be asked to provide information such as your name, email address, billing address, payment details, and shipping address. You agree that all information you provide is accurate, current, and complete, and that you have the right to provide it.

You are responsible for keeping your account credentials secure and for all activity under your account. You may not transfer, sell, assign, or license your account to anyone else.

2. Our Products

We've made every effort to display our products accurately. However, the colors, textures, and finishes you see may vary slightly depending on your screen, device settings, and lighting. We don't guarantee that the appearance of any product on your screen will match the physical product exactly.

Product descriptions, availability, and pricing may change at any time without notice. We reserve the right to discontinue any product, limit quantities, or restrict sales to any person, region, or jurisdiction at our discretion.

3. Orders

When you place an order, you're making an offer to purchase. Belvarnè reserves the right to accept or decline any order at our discretion. Your order isn't accepted until we confirm acceptance, and we must receive and process your payment before acceptance.

Please review your order carefully before submitting. We may not be able to accommodate cancellation requests after acceptance.

If we don't accept, modify, or cancel your order, we'll attempt to notify you using the email, billing address, or phone number you provided.

Returns and exchanges are governed by our Refund and Return Policy.

You represent that your purchases are for your personal or household use only, not for resale, commercial use, or export.

4. Pricing and Payment

Prices, discounts, and promotions may change without notice. The price you pay is the price in effect when your order is placed and confirmed in your order confirmation email. Unless stated otherwise, prices don't include taxes, shipping, or any applicable customs or import charges.

Prices on our website may differ from prices at third-party retailers. Promotions are governed by their own terms, which take precedence if there's a conflict with these Terms.

You agree to provide current, complete, and accurate payment information for all purchases. If your payment information changes, please update it promptly.

By providing payment information, you represent that:

(a) the payment information is true, correct, and complete; (b) you are authorized to use the payment method; (c) your payment will be honored by your card issuer or payment provider; and (d) you will pay all charges, including shipping and applicable taxes.

5. Shipping and Delivery

Shipping, processing times, and delivery details are governed by our Shipping Policy, which is incorporated into these Terms by reference.

All delivery times are estimates. Once we transfer products to the shipping carrier, title and risk of loss pass to you. We are not responsible for delays caused by carriers, weather, customs, or other events outside our reasonable control.

Your rights regarding shipping delays under the FTC's Mail, Internet, or Telephone Order Merchandise Rule are described in our Shipping Policy.

6. Intellectual Property

All content on the Services, including trademarks, logos, text, images, graphics, product photography, videos, page design, and the selection and arrangement of all of it, is owned by Bevel Brands LLC, our affiliates, or our licensors, and is protected by U.S. and international intellectual property laws.

These Terms allow you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the Services without our prior written permission.

The Belvarnè name, logo, product names, and slogans are trademarks of Bevel Brands LLC. You may not use them without our written consent. Shopify's trademarks belong to Shopify. All other trademarks belong to their respective owners.

All rights not expressly granted in these Terms are reserved by Bevel Brands LLC.

7. DMCA Copyright Takedown

If you believe content on our Services infringes your copyright, please send a written notice to info@belvarne.com that includes:

A physical or electronic signature of the copyright owner or authorized agent;

Identification of the copyrighted work claimed to be infringed;

Identification of the material on our Services that you claim is infringing, with enough detail for us to locate it;

Your contact information (address, phone number, and email);

A statement that you have a good faith belief that the use is not authorized; and

A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We may remove or disable access to allegedly infringing material and may terminate the accounts of repeat infringers.

8. Optional Tools and Third-Party Services

We may provide access to third-party tools that we don't monitor or control. These tools are provided "as is" and "as available" with no warranties, representations, or endorsements from us. Your use of any third-party tool is at your own risk, and you should review the third party's terms before using it.

We may release new features and tools through the Services in the future. These will also be subject to these Terms.

9. Third-Party Links

Our Services may contain links to third-party websites or embedded third-party content. We don't review, endorse, or take responsibility for third-party websites or their content. If you choose to visit a third-party site, you do so at your own risk.

We're not liable for any harm or loss related to your use of third-party websites or your purchase of third-party products. Please review the third party's policies before transacting with them.

10. Relationship with Shopify

Belvarnè is powered by Shopify, which provides the infrastructure for our Services. However, all sales and purchases are made directly with Bevel Brands LLC, not Shopify.

By using the Services, you agree that Shopify is not responsible for any aspect of any transaction between you and Belvarnè, including any injury, damage, or loss. You release Shopify and its affiliates from all claims arising from your purchases or transactions with Belvarnè.

11. Privacy

Personal information collected through the Services is governed by our Privacy Policy. Some information may also be subject to Shopify's privacy practices, since Shopify hosts and processes data on our behalf. By using the Services, you acknowledge that you've read our Privacy Policy.

California Residents: California residents have specific rights under the California Consumer Privacy Act (CCPA), including the right to know, the right to delete, and the right to opt out of the sale or sharing of personal information. 12. Feedback and User Content

If you submit ideas, suggestions, reviews, photos, comments, or any other content to us ("Feedback"), you grant Bevel Brands LLC a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for any purpose, including commercial use.

You represent and warrant that:

(a) you own or have the rights to all Feedback you submit;
(b) you have disclosed any compensation or incentives you received in connection with the Feedback (such as affiliate or sponsorship arrangements); and
(c) your Feedback complies with these Terms.

We're not obligated to keep Feedback confidential, pay you for it, or respond to it.

We may, but aren't required to, monitor, edit, or remove Feedback that we believe violates these Terms or is unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable.

You agree your Feedback won't violate anyone's rights, including copyright, trademark, privacy, or publicity rights, and won't contain false information, malware, or impersonate anyone. You're solely responsible for your Feedback.

13. Errors, Inaccuracies, and Omissions

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any such errors and to change or update information, or cancel orders if any information is inaccurate, at any time without prior notice, even after you've submitted your order.

You may use the Services only for lawful purposes. You may not:

(a) use the Services for any unlawful or malicious purpose;
(b) violate any international, federal, state, or local laws or regulations;
(c) infringe our or others' intellectual property rights;

(g) send unsolicited advertising, spam, chain letters, or similar communications;
(h) impersonate any person or entity;
(i) interfere with anyone's use or enjoyment of the Services;
(j) upload viruses, malware, or other harmful code;
(k) reproduce, copy, sell, resell, or commercially exploit any portion of the Services;
(l) collect or harvest personal information about other users;
(m) scrape, crawl, or use automated means to access the Services; or
(n) bypass or interfere with the security features of the Services.

We may suspend, disable, or terminate your access at any time if we believe you've violated these Terms.

15. Termination

You may stop using the Services at any time.

We may suspend or terminate your access to the Services (or any part of them) at our sole discretion, at any time, without notice, if we believe you've violated these Terms or for any other reason. You'll remain responsible for any amounts owed up to the date of termination.

The following sections survive termination: Intellectual Property, DMCA, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, Severability, Waiver, Entire Agreement, Assignment, and any others that by their nature should survive.

16. Disclaimer of Warranties

The information on the Services is provided for general informational purposes only. We don't warrant the accuracy, completeness, or usefulness of any information. Any reliance on such information is at your own risk.

EXCEPT AS EXPRESSLY STATED BY BEVEL BRANDS LLC, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Some jurisdictions don't allow the disclaimer of certain warranties, so some of the above may not apply to you.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BEVEL BRANDS LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BEVEL BRANDS LLC IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions don't allow the limitation of certain damages, so some of the above may not apply to you.

18. Indemnification

You agree to indemnify, defend, and hold harmless Bevel Brands LLC, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising from:

(1) your breach of these Terms or any policy incorporated into them; (2) your violation of any law or the rights of a third party; or (3) your access to or use of the Services.

We'll notify you of any claim covered by this section. We may control the defense and settlement of any such claim at your expense, including choice of counsel, but we won't agree to any settlement that imposes non-monetary obligations on you without your consent (which won't be unreasonably withheld). You agree to cooperate in the defense of any covered claim.

19. Dispute Resolution, Arbitration Agreement, and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES WITH BEVEL BRANDS LLC THROUGH BINDING INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

19.1 Informal Resolution First

Before filing a claim, you agree to try to resolve the dispute informally by emailing info@belvarne.com with a description of the issue and your contact information. We'll do the same if we have a claim against you. We agree to negotiate in good faith for at least 60 days before either party initiates arbitration.

19.2 Binding Arbitration

If we can't resolve the dispute informally, any claim, dispute, or controversy arising out of or relating to these Terms, the Services, or any product purchased from Belvarnè will be resolved by binding individual arbitration, not in court.

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration may take place in Wyoming or, at your election, by phone, video conference, or based solely on written submissions. The arbitrator's decision will be final and binding.

This arbitration agreement is governed by the Federal Arbitration Act (FAA).

19.3 Class Action Waiver

YOU AND BEVEL BRANDS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

19.4 Exceptions

Either party may bring an individual claim in small claims court instead of arbitration if it qualifies. Either party may also seek injunctive or equitable relief in court to protect intellectual property rights.

19.5 Right to Opt Out

You have the right to opt out of this arbitration agreement. To opt out, send written notice to info@belvarne.com within 30 days of first agreeing to these Terms, with your full name, address, email, and a clear statement that you wish to opt out of arbitration. Opting out won't affect any other part of these Terms.

19.6 Severability of Arbitration Provisions

If the class action waiver is found unenforceable for any claim, that claim must proceed in court, but the rest of this arbitration agreement will remain in effect for all other claims.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

For any claim not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Laramie County, Wyoming, and you waive any objection to venue in those courts.

Nothing in these Terms limits your rights as a consumer under the laws of your state of residence.

21. Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed. The remaining provisions will stay in full effect.

22. Waiver and Entire Agreement

Our failure to enforce any right or provision of these Terms isn't a waiver of that right or provision.

These Terms, together with our Privacy Policy, Shipping Policy, Refund and Return Policy, and any other policies we post, make up the entire agreement between you and Bevel Brands LLC regarding your use of the Services. They replace any prior agreements, written or oral.

Any ambiguities in interpretation won't be construed against the drafting party.

23. Assignment

You may not transfer or assign these Terms or any of your rights or obligations under them without our prior written consent. Any attempt to do so is void. We may transfer or assign these Terms freely, without notice or consent.

24. Headings

Section headings are for convenience only and don't affect the meaning of these Terms.

25. Changes to These Terms

We may update these Terms from time to time. The most current version will always be posted on this page with an updated "Last Updated" date.

For material changes, we'll notify you in accordance with applicable law, typically by email or by a prominent notice on the website, and the changes will take effect on the date specified in the notice.

Your continued use of the Services after changes take effect means you accept the updated Terms. If you don't agree to the changes, please stop using the Services.
